Dave McClurg is a member of Petrie & Stocking’s Labor & Employment practice group.  His extensive litigation experience and focus on employment related issues over the past fifteen years has both strengthened and broadened the scope of services Petrie & Stocking is able to provide for its business clients.


Dave has a long track record of successfully defending employers accused of wrongful termination and discrimination on the basis of race, religion, age, disability and gender. He has also helped many clients defeat the harassment, retaliation and failure to accommodate claims often associated with these discrimination suits. Dave frequently represents employers facing OSHA violations and workers compensation claims alleging safety violations or an “unreasonable refusal to rehire” following a work related injury.


Dave has a wealth of experience involving the litigation of wage & hour, theft of trade secret and breach of duty of loyalty claims, ERISA claims arising from the elimination of retiree health benefits, and the enforcement of non-compete and confidentiality agreements. He also counsels management on union avoidance strategies and represents businesses in grievance arbitration hearings conducted under the provisions of collective bargaining agreements.


Although Dave is well-equipped to represent the interests of clients who are forced into litigation, much of his time is devoted to working with clients to minimize the risk of litigation by developing and implementing appropriate employment policies, manuals, procedures and agreements to address potential problems before they arise. He regularly advises clients on issues relating to reduction-in-force layoffs, terminations, severance agreements and return to work issues to help employers avoid pitfalls that can lead to expensive claim.
